Fenech & Fenech Advocates on Monday shared that its Partner and Head of Litigation Edward Debono, together with Associate Nicholas DeBono, served as plaintiff’s lead counsel in last Friday’s hospital judgement.

The State concession to Vitals, later passed on to Steward Health Care, concerned the running and operating of St Luke’s Hospital, Karin Grech Hospital and Gozo General Hospital. The court judgement, delivered by the First Hall of the Civil Court, declared that the concession was vitiated by fraud, and thus the contract covering the agreement is null and void.

The five-year legal battle was led by former Nationalist Party Leader and current Opposition MP Adrian Delia, and it resulted in Judge Francesco Depasquale ruling that the three hospitals should be returned to Government within three months. Reports indicate that a “shadow team” has been ready to take over operations of the hospitals since last summer.

Posting following the decision, Dr DeBono said that he is proud to have contributed to this “historic case that has led the Maltese people to getting back three state hospitals due to a court declared fraudulent deal”.
