The Government has launched a reform of Malta’s Industrial Tribunal, aiming to deliver faster decisions, introduce clear legal guidelines for compensation, and ensure greater consistency among tribunal rulings.

Parliamentary Secretary for Social Dialogue Andy Ellul announced the initiative during a press conference, where he also unveiled the appointment of an Advisory Committee. This Committee, which includes the Tribunal’s chairpersons and key social partners, will work alongside the Government to draw up proposals on how the Tribunal can be strengthened and modernised.

The Industrial Tribunal serves a crucial role in Malta’s employment landscape, resolving disputes between employers and employees while safeguarding workers’ rights and workplace conditions.

Among the planned reforms is the introduction of clear legal parameters for compensation awards. Dr Ellul explained that this will provide much-needed clarity for employers and employees alike, reducing uncertainty in compensation cases.

Although the number of new cases at the Tribunal has remained relatively stable in recent years, Dr Ellul stressed that the evolving nature of Malta’s labour market  including near full employment and rapid technological changes  has highlighted the need for a more agile and well-resourced Tribunal.

“This reform is essential to ensure decisions are delivered swiftly and fairly. It also prepares the Tribunal to address emerging challenges, such as new technologies and work models,” Dr Ellul said. He added that the reform aligns with Malta’s Vision 2050 goals, which call for cohesive policies across all sectors.

Advisory Committee Chairperson Christine Calleja noted that the Tribunal is currently facing technological and infrastructural limitations, as well as delays in hearing cases. She said the proposed reforms would provide the Tribunal with additional resources and improve both efficiency and legal certainty.

The Advisory Committee is expected to present its proposals in the coming months.
